Terminating Probation Early

If you have been unable to get a job because you are on probation, Ms. Sena may be able to have your probation terminated, even though the 3, 4 or 5-year period you agreed to has not passed.

Expungements

If you have been convicted of a charge, Ms. Sena may be able to have that conviction erased, no matter how long ago the conviction occurred. Expungements work so as to withdraw a guilty plea and enter a not guilty plea in its place. They then show that the case was dismissed. An expungement allows a person to truthfully say that they’ve never been convicted of a crime.

Expungements are not available to those who have gone to state prison and although they may be considered “rehabilitative”, law enforcement, immigration and licensing agencies retain the ability to see behind expungements.

Certificates of Rehabilitation

A Certificate of Rehabilitation is an official recognition that a person has been “rehabilitated” and a determination that certain rights should be restored to that person. Obtaining a Certificate of Rehabilitation is the ONLY way a registered sex offender is able to legally stop registering. Once a Certificate of Rehabilitation is granted, it becomes an automatic application to the Governor for a pardon.

Certificates of Rehabilitation are not available for certain sexual offenses or to defendants who have been to state prison. Further, they can only be sought after a case has been expunged.

In the history of Orange County, only a couple of Certificates of Rehabilitation for registered sex offenders have ever been granted. In 2009, Ms. Sena was able to get a Certificate of Rehabilitation for a client, who is now free of the obligation of having to register as a sex offender.

Pardons

A convicted felon can have many of his rights restored if granted a pardon by the Governor’s office. Rehabilitative efforts are key in getting a pardon granted.
